Joe Burke, Esq - backside still glistening -- still "innovative and resourceful"

Joe Burke, his partner Kenneth Gomez, and swindler John Siebert, MD, have left a paper trail of fraud, spoliation, tampering and corruption long enough to wrap up the empire state building. Burke's acts of tampering and corrupting court referees via ex parte emails, bribery and fraud have been documented and exposed in Scamraiders archives. Burke set-up and used Referee Jack Suter to write illegal orders that Burke admittedly knew were illegal barred and precluded.

Burke also schemed to disavow notarized agreements and release signed by crook John Siebert in Nov 2003 before notary Gloria Rivera, who knew Siebert well. Burke, using the lingo of a forger, claimed the documents were 'cut & paste'. This, of course, was outright perjury, as Ms. Rivera produced an affidavit that the documents are genuine and executed by Siebert in her presence.

Undaunted then, Burke, Siebert and tag-along Ken Gomez got to another notary in California and came up with an even more bizarre scam. Jim Couri supposedly was forging that notary's stamp on his own affidavits. This was, according to con-man Burke, in the center of Los Angeles where there is no shortage of notaries. All the while, Burke was harassing Ms. Rivera with ex parte calls and letters.

Burke is a master at ex parte corruption, deception and fraud. Now the icing on the cake: this fraud and thief has admitted, in his own pleadings, that he knew that a note of issue in this case was filed on Mar 22, 2006. When this document is filed, it stays and stops all discovery, as it means that the case is 'trial ready'.

Not only did Jim not file the document - you can all see that the note of issue has been tampered with - it is clear that the case caption is written in a different hand and there are 'additions' made in the document Jim would not have made - most glaring and noteworthy is the fact that Siebert waved, in the Dec 2002 settlement agreement, any defenses & counterclaims against Jim in the event of Siebert's defaulting on the payment of settlement notes.

Siebert also waved any trial by a jury. Yet in the note of issue here, Burke cunningly marks 'trial by jury demanded on all issues,' then files the document , pays the fees to make it appear that Jim filed the document. Also note the document was filed on Mar 22, 2006. Burke admits in his own pleading that Jim departed for California on Mar. 20, 2006.This fact proves that Jim could not have filed the note of issue in NYC, two days after he departed for Los Angeles. It appears beyond doubt that Mr. Burke is not only a resourceful and innovative liar and fraudster, but his is a well versed forger.

In fact, the record now proves that Burke himself filed the document and then secreted (spoliated) the document and permitted illegal discovery to continue for over three years. Burke, in the process, filed perjured documents with the trial court and at the Appellate Division 1st Ddept. Burke claimed that Jim did not comply with discovery that Burke knew was illegal and barred.

In sum, Burke defrauded Jim and the courts and caused Jim's complaint to be struck illegally. We are wondering how the courts can condone Burke's acts which are crimes. Burke and Siebert can not any longer be protected by corrupt system. We attach the subject note of issue/certificate of readiness and Jim's transmittal letter to the court. To be sure, Jim did not file the document on Mar 22, 2006, or any other time, as if he had, all disclosure would have been terminated the next day - and surely would not have sat silent and allowed the illegal disclosure and perjured appeal by Burke/Siebert to be conducted.

This exercise reveals the systemic corruption and criminal acts ongoing in the NY courts. Burke is a crooked lawyer, desperate to rob Jim's $20million and extort him with the aid of Gomez and George Pavia and others.
